The CEO of a popular protein bar company is speaking out in defense of his product following a recent proposed class action lawsuit over the bars' nutrition labels.

Peter Rahal, CEO and founder of David Protein, shared a letter to customers and partners on LinkedIn on Thursday, addressing the lawsuit and breaking down the science of calorie measurement.

The proposed class action suit was filed in the Southern District Court of New York and accuses Linus Technologies Inc., the food technology company behind the cult-favorite gold label protein bars, of mislabeling calories and fat.

"The lawsuit alleging that David Protein bars contain more calories and fat than stated on their nutrition labels is simply wrong," Rahal said in his letter on Thursday. "It rests on a flawed and misleading interpretation of how calories are determined for certain ingredients under U.S. food labeling regulations."

The lawsuit comes amid a rising trend of health-minded consumers reaching for high-protein and lower-sugar snacks, which as a category relies heavily on nutrition marketing and labeling.

Plaintiffs in the suit allege laboratory tests found David products contain up to 83% more calories and up to 400% more fat than stated on their labels.

The complaint, obtained and reviewed by ABC News, calls the company's marketing practices "unlawful and deceptive," and argues that it violated Food and Drug Administration regulations by using misleading health statistics to drive sales.

According to the complaint, the plaintiffs hired an accredited lab to analyze the bars, with the results allegedly differing from David's front-of-package labeling, which states that the bars contain 28 grams of protein, zero sugar, and 150 calories.

The suit claims Linus Technologies "knowingly" used numbers that would appeal to health-minded shoppers, particularly those seeking high protein with minimal calories and fat.

In his letter this week, Rahal said the laboratory testing referenced in the suit "relies on bomb calorimetry, a laboratory method that measures total heat released when food is completely burned, and applies the standard 4-4-9 caloric values for carbohydrates, protein and fat, respectively."

The David founder said that "bomb calorimetry is a recognized calorie testing method for many foods" but that the industry widely believes it is not the right method "for determining calories in foods containing certain ingredients, such as dietary fiber, certain sweeteners, and, critically for us, fat substitutes like esterified propoxylated glycerol (EPG)."

Rahal said the FDA permits "the use of six different calorie calculation methods" and allows for "specific caloric values for approved ingredients."

Ingredients such as carbs, fiber, or EPG, when burned in a calorimeter, "would appear to deliver far more calories than the body actually metabolizes," Rahal said. "In reality, these ingredients are not fully bioavailable and therefore do not yield their full caloric content when ingested."

Citing FDA rules, Rahal said the "fat content in our bars is also accurate and compliant."

"Our products are labeled correctly and in full compliance with all FDA regulations. The claims in this lawsuit are meritless and reflect a fundamental misunderstanding of basic, well-established scientific principles regarding how calories are determined under U.S. nutrition labeling standards for ingredients like EPG," he added.

The plaintiffs are seeking damages, restitution and injunctive relief. The suit does did not detail specific lots or request a recall of any products, and no regulator has announced enforcement action tied to the claims.

An avian flu outbreak, which killed several elephant seals at California's Año Nuevo State Park last month, has spread to two other mammal species, according to researchers.

Laboratory testing confirmed the virus had spread to nine additional elephant seals, a southern sea otter and a sea lion, Christine Johnson, director of the Institute for Pandemic Insights at the UC Davis Weill School of Veterinary Medicine, and other wildlife specialists said during a media briefing on March 12.

Scientists estimated that more than 60 marine mammals may have been infected by the virus and are currently being tested.

In total, scientists have confirmed that 16 elephant seals are infected with the HPAI H5N1 virus, commonly known as avian flu; however, Johnson noted that these numbers reflect only animals that have undergone rigorous testing.

"We know there are more animals with signs of infection that we have sampled that are being tested across the different laboratory systems," Johnson said. "There are likely more animals that will be on in the coming weeks."

Although all confirmed cases were found in mammals in San Mateo County, Año Nuevo State Park and Año Nuevo Island Reserve, Johnson noted that scientists have detected some cases "slightly to the south and to the north" of Año Nuevo, specifically in dead animals found on public beaches.

"It's not at all unusual that this outbreak is impacting additional species, like we are seeing in the new cases with a sea otter and a sealion," Johnson said. "H5N1 outbreaks affect a wide range of birds and mammals, and these animals all share the near-shore ecosystem. It is especially tragic when infections impact less-common species (like) the southern sea otter."

Patrick Robinson, the Año Nuevo Reserve director at UC Santa Cruz, shared that scientists have found about 47 dead seals — both pups and adults, particularly males — along the shoreline since the outbreak began.

"Although some mortality of weaned pups are expected, this year's mortality rate has been about four times higher compared to last year's," Robinson said. "The death rate in large males is basically nonexistent in most years. We don't typically see large males passing away on beaches."

Robinson also noted that the mortality rate of elephant seals living on the Farallon Islands off the coast of San Francisco appears to be about "three times higher" compared to the deaths along the shore, based on drone surveys.

But in some good news, Robinson said the virus appears to be nonexistent among adult female elephant seals. About 80% of female seals had left the region as part of their foraging migration before the avian flu outbreak in mid-February.

"To date, no female elephant seals have been observed to be symptomatic or dead," Robinson said.

The risk of the avian flu transmitting to the general public is very low, though the disease can spread between animals and people. Scientists recommend avoiding areas with infected animals, not touching live or dead seals, and not allowing pets to approach them.

Utah's measles outbreak is speeding up as it spills into the eighth month, getting so bad that some local health officials have turned to talk radio to get the message about vaccination to more people.

As South Carolina seems to be getting a handle on its outbreak — the largest in the United States in three decades — measles in Utah is raging through unvaccinated children in several communities. There have been almost 100 confirmed illnesses in Utah in the last three weeks and likely many more families have been affected, experts say. More people have caught measles in the first few months of this year than all of last year.

Since measles began spreading in Utah last summer, state health officials have barely acknowledged it. Health officials in the southwest corner of the state, which still accounts for the bulk of cases, haven't been holding vaccine clinics, they say, because most residents aren't interested in getting the shots.

During the state's first media briefing March 5, state epidemiologist Dr. Leisha Nolen pleaded with residents to get vaccinated. A nurse practitioner recounted in detail several severe measles cases she's treated. A number of families who had coped with the virus "didn't realize how bad" measles was, Nolen said.

The Utah Department of Health and Human Services has its website weekly but has otherwise remained largely silent. The agency hasn't posted about the outbreak on its Facebook and X platforms since the outbreak began. The agency declined a request for interview.

In southwest Utah, a remote tight-knit community which has accounted for most of the cases, it's been a struggle to reach residents. Most people in the area are linked to the Fundamentalist Church of Jesus Christ of Latter-day Saints (FLDS), a religious group that is wary of outsiders. Vaccination rates are very low among school-age kids.

David Heaton, public information officer for the Southwest Utah Public Health Department, said there's no main television station or newspaper in the five counties under his agency's jurisdiction. Instead, he has harnessed social media and talk radio to provide updates on the outbreak.

"We do a lot of radio spots, probably two to three times a week," he said. "Talk radio is big down here."

Heaton's messaging on measles vaccinations has evolved throughout the outbreak.

"We're trying to find ways of tweaking the message," he said. "If you don't want to get all your vaccines, at least get this one. Or we've started saying, consider who's in your circle. Are there little kids under 5 that might have a harder time healthwise if they get measles?"

Few seem to be listening.

"There hasn't been any sense of alarm or living life differently," he said. "I'm surprised by some people who I talk to informally who still haven't heard the message, which makes me wonder, are we covering all of our bases? Is there something we're not aware of?"

There's a different response among people living in the northeastern part of the state. The TriCounty Health Department, which encompasses three counties, has had five measles cases since mid-February. The agency saturated its social media with information and held two vaccine clinics.

Thirty-three people showed up to get vaccinated, said Sydnee Lyons, TriCounty Health's public information officer.

"Our community is going above and beyond in terms of asking questions and making the right decisions for their families and trying to protect not only themselves but their community members," Lyons said. "Everyone's working together."

Measles is the most contagious virus known in the world. When it infiltrates pockets of unvaccinated people, up to 9 out of 10 will become infected. People who are infected can spread the virus four days before the characteristic rash shows up.

While the virus is continuing to spread uncontrolled in the southwest part of Utah, other parts of the state — including areas closer to Salt Lake City — are now experiencing increases in cases.

According to an NBC News/Stanford University investigation, the MMR vaccination rate for kindergarteners in hard-hit Washington County is 79.2%. It's 92.6% in Salt Lake County, which had measles exposures at hospital emergency departments, a restaurant, a gas station and an aquarium last week alone. An immunization rate of 95% is needed, experts say, to achieve the level of herd immunity to prevent outbreaks.

Containing measles outbreaks relies on effective communication encouraging the public either to get vaccinated or to stay away from others until the threat passes.

In South Carolina, state epidemiologist Dr. Linda Bell has held dozens of public briefings — one each week since the outbreak was declared in early October. The briefings are publicly available on the agency's website. The state rolled out mobile vaccine clinics and invited public health experts to help with contact tracing and data management.

Because Utah's public health system is decentralized, it's up to local and regional health departments to respond to outbreaks the way they see fit.

The Southwest Utah Public Health Department is not holding vaccine clinics.

"We have the capacity," Heaton said, "but there's been no surge in demand for the vaccines."

ATLANTA (AP) — State senators on Friday grilled the former special prosecutor who led the Georgia election interference case against President Donald Trump about communications his team had with federal investigators. But their efforts were largely frustrated by his repeated assertions that he couldn't remember details.

Nathan Wade appeared before a subcommittee of the Special Committee on Investigations, which was created by the Republican-dominated state Senate in January 2024 to examine various allegations of misconduct against Fulton County District Attorney Fani Willis, an elected Democrat, with regard to her prosecution of Trump.

While the committee has met multiple times to hear from witnesses, including a combative appearance by Willis in December, it has unearthed little that wasn't already known. Republicans expanded the committee's mission to also look into Democrat Stacey Abrams, but the committee has thus far done nothing publicly with her.

Willis obtained an indictment against Trump and 18 others in August 2023. Using Georgia's anti-racketeering law, she alleged that they had participated in a wide-ranging conspiracy to illegally overturn Trump's narrow loss in Georgia. Four people pleaded guilty in the months that followed after reaching deals with prosecutors.

The resolution creating the committee focused on Wade's hiring as a special prosecutor, saying a romantic relationship between him and Willis amounted to a "clear conflict of interest and a fraud upon the taxpayers" of the county and state. An appeals court in December 2024 removed Willis from the case, finding the relationship created "an appearance of impropriety," and a new prosecutor dismissed it last November.

While the senators did ask Wade about his hiring — including the timing and how he came to be chosen — there was no mention of his romance with Willis. An opening statement Wade read at the start of the hearing indicated that there had been an agreement beforehand that no personal relationship would be discussed.

Mostly, though, Sen. Greg Dolezal asked Wade about his invoices, particularly several billing entries that seemed to indicate contact with the U.S. House committee that investigated the Jan. 6, 2021, attack on the U.S. Capitol and meetings with U.S. Department of Justice officials. But Wade repeatedly said he could not recall when trips or calls happened, who he met or spoke with, who else from his team had participated or what was discussed.

Wade also pushed back, saying there seems to be a big focus on who the team was talking to, but he asserted that the investigative work was done by the team Willis assembled.

"She led us, I led the team and we did the work," he said. "We didn't get assistance, coordination, however you want to characterize it. No one held her hand and guided her through the process. This is her work."

Speaking to reporters after the hearing, Dolezal conceded that he did not get everything he wanted. "Look, I wish Mr. Wade had a better memory," he said, adding that he appreciated Wade appearing and answering questions "to the best of his recollection."

But Dolezal said he was glad to have established that Wade and his team met with someone connected with the Jan. 6 investigation and also that they were in touch with Department of Justice officials. He said it raises questions about how much coordination existed in an attempt to "get Trump."

"That notion that it was part of some big conspiracy is absolute fiction," said Andrew Evans, a lawyer for Wade. He accused the Republican senators of trying to use the committee to shift the focus from real issues that are unfavorable to them as midterm elections approach.

Including Dolezal, who is running for lieutenant governor, four of the five Republicans on the committee are running for statewide office in 2026. Bill Cowsert is running for attorney general, while Sens. Blake Tillery and Steve Gooch are also each seeking the Republican nomination for lieutenant governor. Another Republican who had been on the committee, John Kennedy, resigned to pursue his own lieutenant governor bid. Only Dolezal and Cowsert were present for Friday's subcommittee meeting.

The subcommittee also heard testimony Friday from Fulton County Deputy District Attorney Jeff DiSantis, who handles media relations for Willis' office. He was asked about Wade's hiring, which he said he wasn't aware of until it had been decided, and about the district attorney's office's use of a media monitoring service.

Pizza Hut announced March 11 that it's seeking out a Hut Crust Connoisseur — a.k.a. a professional pizza crust tester — who is "dedicated to tasting and reviewing Pizza Hut's iconic crusts," the restaurant shared in a press release.

"You eat your crust. You eat your friend's crust. You'd eat a stranger's crust if it wasn't 'weird,'" Pizza Hut wrote on its application page. "We want you."

If free Pizza Hut crust isn't enough incentive to apply for the job, the pizza chain is also offering its Hut Crust Connoisseur $31,415.92 (a nod to Pi Day, coming up on March 14) and free pizza for one year in exchange for their services.

Additional perks to the job include "saying, 'I can't, I'm working' while eating pizza" and "formal recognition that your opinions are correct," per the application page.

The new position is part of the brand's new Hut Crust platform, which offers customers a $10 three-topping pizza, availabel in three of the restaurant's classic crusts: the Hand Tossed, Tavern Style, or Thin 'N Crispy. The Hut Crust Connoisseur will act as "the official guardian of the Hut Crust Platform," per the release.

To apply, crust aficionados should not submit a resume, but instead craft a "crust manifesto." "So basically what we need to do is, we need to create a path where we expose Amanda Ghost," Jed says. "Amanda Ghost is like the new Heidi Fleiss. Like, she masquerades as — the reason why she sucks so bad at music is because she's actually getting hookers for Blavatnik, right, and that's what she does."

Amanda worked as a co-producer on Rebel's 2024 film The Deb, which the actress also directed. Bryan Freedman, a famed Hollywood lawyer who once represented Justin Baldoni in his lawsuit against Blake Lively, is also mentioned. Bryan was representing Rebel at the time of the call.

Rebel and her former collaborator have been engaged in a legal battle since 2024. Amanda filed a defamation lawsuit against the actress. In the suit, Amanda alleges she and her PR team were behind alleged smear websites involving her. One website accused her of "procuring young women for the pleasure of the extremely wealthy."

Lana Condor says it was hard to keep her surprise appearance in XO, Kitty a secret

The To All the Boys I've Loved Before actor said she's "bad at lying" and felt like she had to keep the secret for "three years"

Condor said the best part about being on set was reuniting with her former co-star Anna Cathcart

Lana Condor almost spilled the beans about her surprise appearance in the forthcoming third season XO, Kitty.

In a Thursday, March 12 interview with Entertainment Tonight, Condor, 28, talked about the rom-com TV series that's a spinoff of her 2018 movie, To All the Boys I've Loved Before. She admitted that it was hard for her to keep her surprise appearance in the new season a secret.

"I'm so bad at lying," she said. Condor joked that it felt like she had to keep the casting news a secret for "three years."

Anna Cathcart, who plays Condor's younger sister in the series, said she's happy that the news is finally out.

"It feels illegal that I can talk about it now because even her name in the script was a different name. We were being so careful, so I can't believe that we can announce it," she said.

Condor confirmed that they used a different name for her in the script. The Pretty Lethal star recalled it being something "random" like "Emma or Beatrice."

On March 6, Netflix revealed that Condor would be making an appearance in the new episodes of XO, Kitty when they shared an Instagram video of her sitting next to Cathcart, 22, on set.

In the comments, Condor shared three heart-eyed emojis.

While speaking with ET, Cathcart revealed what it was like to reunite with Condor on set.

"Honestly, I feel like no time has passed. We immediately went back into that sister dynamic and I felt like I was 14 again and she was in her early 20s," she said. "Honestly, it felt like a time capsule."

Condor said it was a special experience for her as well because she really got to see how the universe of To All the Boys I've Loved Before had expanded.

"It was my first time getting to step into Anna's world and XO, Kitty is her entire world," she said. "She made that completely on her own by herself and it was so exciting to step into her world and be able to see what she's been able to accomplish."

Condor expressed the same sentiment in an interview with Netflix Tudum.

She said, "It's such a joy to be able to come back and see Anna."

"I think she did an amazing job creating the XO, Kitty world. It's such a dream to be able to work with her again. I feel really excited and happy and honored I get to be back," she added.

Season 3 of XO, Kitty premieres on Netflix on April 2, 2026
