A single mum who was fired for consuming a £1.50 Tesco tuna sandwich whereas at work says the best way she was handled was 'inhumane'.

Gabriela Rodriguez, 39, has been accused of theft by her cleansing contractor Complete Clear, after taking the sandwich from a leftover platter at Metropolis regulation agency in London.

Bosses – who paid the cleaner £13.08 an hour – accused Ecuadorian-born Gabriela of taking 'shopper property…without authority or affordable excuse'.

The mum, who relocated to the UK from Spain a decade in the past together with her 10-year-old youngster Nicole, stated all she did was eat a small sandwich that was in all probability going to finish up within the bin.

'There should have been around 5 trays with left-over meals, together with crisps and sandwiches, and I only took one small one with tuna and cucumber inside,' she informed the Daily Mail.

Campaigners from UVW Union for migrant staff protested her dismissal by marching outdoors Devonshire's workplaces armed with 100 cans of tuna and 300 sandwiches.

Placards have been held which read 'Sacked for a Sandwich?' and 'We aren't the filth – we clean', and gave out leaflets which read: "I ate a leftover tuna sandwich and received sacked!'.

The union is appealing her sacking and in an open letter wrote: 'There were numerous full trays of leftover sandwiches that had been laid out for workers to eat.

'Gabriela& understood she was also allowed to eat this food.

'It is so extremely far beyond the realms of reasonableness and comprehension to dismiss an employee for eating a leftover tuna and cucumber sandwich.

'We now understand that the privilege of consuming leftover sandwiches perhaps doesn't prolong to the outsourced migrant workforce within the constructing.'

Supporters say she worked for the company for two years and had an 'impeccable' report.

UVW common secretary Petros Elia added: 'Cleaners are routinely dismissed on trivial and, we argue, discriminatory, grounds like this day-after-day around the nation.

'Many describe feeling treated like the dust they clean, and& Gabriela& is certainly one of them.'

But Gabriela was advised by her Complete Clean boss Graham Petersen: 'On the hearing your rationalization was that you simply found a sandwich within the kitchen near the top of your shift and took it with out giving it a second thought.

'You said that beforehand the shopper had left meals within the kitchen and provided it out, so that you thought it was advantageous.

'I thought-about your rationalization to be unsatisfactory because you confirmed that no one had provided you the meals in the kitchen but decided to take it anyway.

'I have decided that your conduct has resulted in a elementary breach of your contractual terms which irrevocably destroys the belief and confidence necessary to continue the employment relationship.'

Complete Clean stated in a press release: 'It is very important us to take care of the integrity of our workforce and repair by making certain we deal appropriately with any actions that undermine the arduous work and fame of our unimaginable workforce who conduct themselves impeccably.

'Belief and honesty is of paramount importance.

'All steps taken have been in accordance with UK employment regulation following the right investigative and disciplinary process. We will probably be making no further comment on the matter.'

A spokesperson for Devonshires added: 'Devonshires did not make a formal grievance towards& Gabriela& and expressly informed Complete Clear to not take any towards her.

'Complete Clear carried out their very own investigation and the decision to dismiss& Gabriela& was taken without any enter or influence from Devonshires by any means.

'This can be a personal matter between Complete Clear and& Gabriela& but we have now made clear to Complete Clean that we might not object, as we by no means have accomplished, to& Gabriela& attending and working on our premises if Complete Clear modifications its position.'
